Introduction

learning.dev respects your privacy. We offer e-Learning services that enable you to securely store and process your e-learning data.

This Privacy Policy describes the types of personal information we collect through our products and services and via our online presence, which include our main website learning.dev This policy also describes how we use Personal Data, with whom we share it, your rights and choices, and how you can contact us about our privacy practices.

What personal data we collect and why we collect it

Platform creation

Personal Information that we collect may include, but is not limited to, your name and email address, for the purpose of creating your account.

Handling this data also allows us to:

  • Send you important account information.
  • Respond to your queries or complaints.
  • Set up and administer your account, provide technical and/or customer support, and to verify your identity.

Checkout

We collect information about you during the checkout process on your learning.dev platform. This information may include, but is not limited to, your name, email address, phone number, and any other details that might be requested from you for the purpose of processing your orders.

Handling this data also allows us to:

  • Send you important account/order/service information.
  • Respond to your queries or complaints.

We use a third party payment processor to process payments made to us. In connection with the processing of such payments, we do not retain any financial information such as credit card numbers. Rather, all such information is provided directly to our third party processor, Stripe, whose use of your personal information is governed by their privacy policy.

Additionally we may also collect the following information:

  • Location and traffic data (including IP address and browser type) if you place an order, or if we need to estimate taxes and shipping costs based on your location.
  • Product pages visited and content viewed while your session is active.
  • Your comments and product reviews if you choose to leave them on our website.
  • Account email/password to allow you to access your account, if you have one.
  • If you choose to create an account with us, your name, address, and email address, which will be used to populate the checkout for future orders.

Contact forms

If you use our contact form or e-mail us directly we capture your first name, last name and e-mail address, in addition to any information you tell us. We keep contact form submissions for a period of one year for customer service purposes.

We may send you email marketing communications about learning.dev products and services provided that we do so in accordance with the consent requirements that are imposed by applicable law.

By voluntarily providing us with Personal Data, you are consenting to our use of it in accordance with this Privacy Policy. The Personal Information that you provide can be accessed at any time through your account or you can contact our customer support at support@learning.dev if you need help accessing your account.

We use a third-party email provider to store emails and contact form submissions you send us.

If you visit our website or a user visits your learning.dev platform we only store Strictly Necessary Cookies. These cookies are essential for you to browse the site and use its features, such as accessing secure areas of the site.

Analytics

learning.dev does not perform any data analytics.

Users of our services

Content

We collect and store Content that you create, input, submit, post, upload, transmit, store or display in the process of using our “Site”. Such Content includes any Personal Information or other sensitive information that you choose to include ("incidentally-collected Personal Information"). Although Berry Cloud Ltd owns the code, databases, and all rights to the learning.dev platform, Customers retain ownership, control and all rights to their content, records and data which are their property.

User data

Your data is subject to the individual Privacy policy of the learning.dev platform on which you are registered. We collect data that you submit to our “Site” or as you participate in any interactive features of the learning.dev platform. We collect Information under the direction of our Customers and often have no direct relationship with the individuals whose Personal Information we store. Customers retain ownership and all rights to this data and customers' user data is not shared or analysed by us. If you are an employee or user of one of our Customers' platforms and would no longer like us to process your information, please contact your administrator.

In some cases another User (such as an administrator) may create an account on your behalf and may provide your information, including Personal Information. All data submitted by our customers and our customers users is subject to our customers own Privacy Policy which should be made available to users of their platform.

We will display your Personal Information in your profile page and elsewhere on the Site. You should be aware that the administrator, as well as specially designated support personnel, may be able to access information in and about your account. You can review and revise your profile information at any time.

Who we share your data with

Berry Cloud Ltd does not sell or rent Personal Data to marketers or unaffiliated third parties.

We share Personal Data with a limited number of our service providers. We have service providers that provide services on our behalf, such as website hosting, data analysis, email delivery, and auditing services. We authorize such service providers to use or disclose the Personal Data only as necessary to perform services on our behalf or comply with legal requirements. We require such service providers to contractually commit to protect the security and confidentiality of Personal Data they process on our behalf. Our service providers are located in the United Kingdom, European Union and the United States of America. The trusted entities we use and their privacy policies are outlined below.

How long we retain your data

If you submit a message using the contact form, this message will be retained for one year.

We retain your Personal Data as long as we are providing the Services to you. We retain Personal Data after we cease providing Services to you to the extent necessary to comply with our legal and regulatory obligations, and for the purpose of fraud monitoring, detection and prevention. We also retain Personal Data to comply with our tax, accounting, and financial reporting obligations. Where we retain data, we do so in accordance with any limitation periods and records retention obligations that are imposed by applicable law.

Data created by the users of your learning.dev platform will be deleted immediately if you delete your platform. Each learning.dev platform’s data are retained for as long as the Customer's paid subscription to the service or free plan lasts. If a Customer elects not to renew a Subscription, the Customer's account is downgraded to the free version of the Services. If a Customer has a free version account and does not log into an account for more than 365 days, that account is permanently deleted. We will provide reminder notifications before deleting a Customer’s account.

What rights you have over your data

If you have an account on a learning.dev site you can request to receive the personal data we hold about you by contacting your site's administrator. You can also request that your administrator erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

If you are the administrator of a learning.dev site you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Where we send your data

European data protection law requires data about European residents which is transferred outside the European Union to be safeguarded to the same standards as if the data was in Europe. Our third parties mentioned above are all certified certified under the EU-US Privacy Shield.

How we protect your data

While no service is completely secure, we are dedicated to keeping personal information safe and make efforts to ensure a level of security appropriate to the risk associated with the processing of Personal Data. We maintain administrative, technical and physical safeguards that are intended to appropriately protect against accidental or unlawful destruction, accidental loss, unauthorized alteration, unauthorized disclosure or access, misuse and any other unlawful form of processing, of the personal information in our possession.

Your Personal Data is only accessible to a limited number of personnel who need access to the information to perform their duties. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of your account has been compromised), please contact us immediately.
